Resumen de Del control político al control jurisdiccional: aportes de la LO 15/2015 para la construcción del principio de lealtad autonómica en España

La reforma de la Ley Orgánica 15/2015, de 17 de octubre, trajo consigo un debate en torno a las competencias que posee el Tribunal Constitucional de España para ejecutar sus propias sentencias. Si se analizan las críticas en clave territorial, estas se han fundado en el posible traslado de responsabilidades políticas al órgano jurisdiccional. Muchos han enjuiciado la opción del legislador orgánico por considerar que se había dictado una ley a medida del caso catalán. Esto ha quedado de relieve no sólo en el ámbito doctrinal, sino también en votos particulares de algunos magistrados del propio Tribunal. Teniendo en cuenta el principio de lealtad autonómica, como modo de concreción, en el caso español, de la lealtad federal (Bundestreue), se analizará existe una superposición del control político del art. 155, CE, y del control jurisdiccional que reside en la ejecución de sentencias del Tribunal Constitucional o si, por el contrario, son comprensivos, cada uno de ellos, de la posibilidad de desarrollo de este importante principio a nivel autóctono.

The reform of Organic Law 15/2015 of 17 October brought with it a debate on the powers of the Spanish Constitutional Court to enforce its own judgements. If the criticisms are analysed in territorial terms, they have been based on the possible transfer of political responsibilities to the Court. Many professors have judged the option of the organic legislator because they considered that that law had been dictated tailored to the Catalan case. This has been highlighted not only in the academic field, but also in the individual votes of some judges of the Constitutional Court itself. Bearing in mind the principle of autonomic loyalty, as a way of specifying, in the Spanish case, federal loyalty (Bundestreue), our analysis will be made taking account the possible superposition of the political control of art. 155 of the Spanish Constitution, with the jurisdictional control that resides in the execution of sentences of the Constitutional Court or if, on the contrary, they are comprehensive, each one of them, of the possibility of developing this important principle at an autochthonous level.
