¿Estado garante o Estado victimizante? Violencia contra la sociedad y el sector público

    El presente artículo analiza el resultado de la violencia y victimización del sector público y social con base en la ley. Se utiliza el método fenomenológico para mostrar al sujeto estatal victimizador y al sujeto de protección estatal —ambos, al mismo tiempo victimizados—. A partir del enfoque cualitativo y el análisis hermenéutico, se afirma que la intervención del Estado mediante sus instituciones no se justifica y refuta el motivo de su existencia por la simultaneidad de la función latente de victimizar y la función declarada de tutelar derechos a sus propios empleados y a los sectores sociales vulnerados. Se expone así a ambos grupos como víctimas que son utilizadas por el Estado para intentar legitimarse ante la sociedad.

    This article analyzes the result of violence and victimization of the public in all social sectors based upon the current law. The phenomenological method is used to show the victimizing state and state protection-both victimized at the same time. From the qualitative approach and the hermeneutic analysis, it is affirmed that the intervention of the State through its institutions is not justified and refutes the reason for its existence. The latent function of victimizing and the declared function of protecting rights to its employees of all social sectors show that these rights been violated. This exposes victims who are used by the State in order to legitimize itself to society.
