La reciente Sentencia del Tribunal Supremo estima un recurso de casación contra la nulidad de un matrimonio celebrado en China. El Tribunal Supremo considera válida la inscripción en el Registro Consular español de un matrimonio celebrado en el extranjero entre español y extranjero cumplidos los requisitos legales de fondo y forma exigidos para estos matrimonios en nuestro Código Civil tras la reforma de la Ley 15/2015 de Jurisdicción Voluntaria. Los requisitos de fondo comprenden tanto la capacidad para contraer matrimonio como la expresión del consentimiento matrimonial. Del estudio de estos requisitos y si se cumplen en el asunto analizado versa nuestro estudio.

The recent Judgment of the Supreme Court estimates a resource of cassation against the nullity of a marriage celebrated in China. The Supreme Court the inscription considers to be valid in the Consular Spanish Record of a marriage celebrated abroad between Spanish and foreigner fulfilled the legal requirements of bottom and form demanded for these marriages in our Civil Code after the reform of the Law 15/2015 of Voluntary Jurisdiction. The requirements of bottom understand so much the aptitude to marry as the expression of the matrimonial assent. Of the study of these requirements and if they are fulfilled in the analyzed matter our comment turns.
