    The European colonial movement imposed and administered a hegemonic model of world that marked all the modernity, a model that does not give alternatives and that perpetuates discrimination. This study entails demonstrating the historical occurrence of the colonial movement, and present the current epistemologies alternative conquered from the South, the spin-colonial, democracy and the new constitutional movement born in Latin America. Indeed, this transformer nascent constitutional movement in Latin America has emerged as a result of new constituent processes that positivaram principles, values and rights that represent a counterpoint to the constitutional Eurocentric model imposed on Latin America, which proved far from the specific social needs of the continent. In this perspective, wins highlighted the need to reflect on the construction of the idea of nature in the modern and colonial thought and how the notion of colonialism still survives in Latin American nations process, affecting its culture in ways that produce knowledge and how they are determined. The study also aims to examine the way in which the Latin American political Letters they conducted culture of living well, inaugurating the ecocentric constitutionalism aimed at integrating man to nature, breaking with the anthropocentric feature which was based on modern constitutionalism and the dominant pattern of development. Finally, give yourself will focus on the meaning of land ownership proposed by the movement, analyzing the right to ownership of land under a decolonial epistemological perspective, born of the claims and struggles of people who traditionally occupy.

    O movimento colonial Europeu impôs e administrou um modelo hegemônico de mundo que marcou toda a modernidade, um modelo que não confere alternativas e que perpetua a descriminação. O presente estudo enseja demonstrar a ocorrência histórica do movimento colonial e, apresentar as alternativas atuais conquistadas a partir das epistemologias do Sul, o giro descolonial, a democracia e o novo movimento constitucional nascido na América Latina. Com efeito, esse movimento constitucional transformador nascente na América Latina surgiu em decorrência de novos processos constituintes que positivaram princípios, valores e direitos que representam um contraponto ao modelo constitucional eurocêntrico imposto à América Latina, que se mostrou distante das demandas sociais específicas do continente. Nessa perspectiva, ganha evidência a necessidade de se refletir acerca do processo de construção da ideia de natureza no pensamento moderno e colonial e de como a noção de colonialidade ainda sobrevive nas nações latino-americanas, influindo na sua cultura, nos modos que produzem o conhecimento e no modo como que se determinam. O estudo ainda se propõe a analisar o modo pelo qual as Cartas Políticas latino-americanas positivaram a cultura do bem viver, inaugurando o constitucionalismo ecocêntrico que visa integrar o homem à natureza, rompendo com a feição antropocêntrica sobre a qual se pautou o constitucionalismo moderno e o padrão dominante de desenvolvimento. Por fim, dar-se-á enfoque ao significado de propriedade agrária proposto pelo movimento, analisando o direito de propriedade da terra sob uma perspectiva epistemológica descolonial, nascida das reivindicações e lutas dos povos que tradicionalmente as ocupam.
