Resumen de A vida nua do estrangeiro-polites: da anomia da CEDH ao apelo cosmopolita

In a critical legal thinking approach, and taking as prius the lack of objective judicial decisions from the European Court of Human Rights concerning article 16 of its Convention, an essayistic reflection is suggested on the anomy created for the restriction of aliens’ active citizenship. Following the thoughts of Giorgio Agamben on «bare life» and hodiernal «homines sacri», and of Costas Douzinas on the Philosophy of Human Rights, it is suggested that the best way to legally symbolise and solve that anomy implies darning the question about universal citizenship with the one concerning the realization of Human Rights, and contrasting real hospitality to mere symbolic tolerance. Therefore, the cosmopolitan appeal reappears with the transformative and emancipatory potential of Human Rights, opposing the polites to the idiotes.

Através de uma abordagem partidária do pensamento crítico do Direito, e tomando como prius a ausência de decisões judiciais objetivas do Tribunal Europeu dos Direitos do Homem atinentes ao artigo 16º da respetiva Convenção, propomos uma reflexão sobre a anomia criada atinente à restrição da cidadania ativa dos estrangeiros.Assentes nas teorizações de Giorgio Agamben sobre a «vida nua» e os hodiernos «homines sacri» e de Costas Douzinas acerca da Filosofia dos Direitos Humanos, cogitamos que a melhor representação e superação jurídicas daquela anomia envolve cerzir a problemática da cidadania universal com a da realização dos Direitos Humanos e contrapor a hospitalidade real à mera tolerância simbólica. Destarte, o apelo cosmopolita ressurge com o potencial transformador e emancipatório dos Direitos Humanos, opondo o polites ao idiotes.
