A propósito da Lei n.º 8/2017, de 3 de Março: os animais ainda serão coisas (objectos da relação jurídica)?

    Analysing the Law n.º 8/2017, of 3rd March, which aims to establish the legal status of animals - an objective with which the author agree - we can imply the changes that were introduced in the Civil Code, systematically, are not coherent and do not define with clarity the legal concept of animals. In that context, we dismiss the systematic amendment witch insert a new subtitle I-A (Of Animals) at the same level of subtitle I (Of Persons) which undermine the uniqueness of man and his exclusive position as the subject of rights

    Ao fazer uma breve análise da Lei n.º 8/2017, de 3 de Março, que visa estabelecer o estatuto jurídico dos animais – um objectivo com o qual concorda – o autor conclui que as alterações introduzidas no Código Civil são, sistematicamente, pouco coerentes e não definem com a clareza necessária o conceito jurídico dos animais. Neste contexto rejeita a alteração sistemática que consiste na introdução, entre os elementos da relação jurídica, de um novo subtítulo I-A (dos animais) ao nível do subtítulo I (das pessoas) que põe em causa a singularidade do homem e a sua exclusiva posição como sujeito de direitos.
