Sobreendividamento familiar, hipoteca sobre a casa de morada de família e pacto comissório

    Starting from the thematic concerning the causes and origins of the family overindebtedness phenomenon (1), the text that follows focuses on the resort to bank credit as financing instrument for the family residence acquisition and its guarantee (2). In a default situation concerning the borrower’s obligations the mortgage foreclosure will take place in general terms, in which the family residence is neither free from attachment nor subsequent judicial sale (3). The forfeiture agreement as an accessory clause to the mortgage; its prohibition in Portuguese law and respective ratio; the prohibition’s subsistence logic in the present and the eventual paradigm change concerning the forfeiture agreement (4). Conclusion (5).

    Partindo da temática das causas e origens do fenómeno do sobreendividamento familiar (1), o texto que segue centra-se sobre o recurso ao crédito bancário como instrumento de financiamento da aquisição da casa de morada de família e a sua garantia (2). Numa situação de incumprimento das obrigações assumidas pelo mutuário haverá lugar à execução da garantia hipotecária nos termos gerais, não se encontrando a casa de morada de família isenta de penhora nem da subsequente venda executiva (3). O pacto comissório como cláusula acessória da hipoteca; a sua proibição na lei portuguesa e a respectiva ratio; a subsistência da lógica da proibição na actualidade e a eventual mudança de paradigma quanto ao pacto comissório (4). Conclusão (5).
