Resumen de Presente y futuro de la mediación penal en el ordenamiento español: ¿cabe más incertidumbre?

El objetivo del presente trabajo consiste en poner en cuestión los problemas que plantea la implementación de la mediación en el proceso penal. Las bondades de la mediación y de la justicia reparadora son incuestionables. Sin embargo, el ordenamiento jurídico español no se ha dotado de la suficiente cobertura legal para responder a cuestiones tales como qué asuntos son derivables a mediación, a quién corresponde adoptar la decisión, en qué fase o fases del proceso resulta procedente o cómo se integran en el proceso los resultados obtenidos a través de dicho mecanismo. Esta situación de incertidumbre jurídica resulta inexplicable considerando que ya se ha transpuesto la Directiva 2012/29/UE sobre tutela de las víctimas (Ley 4/2015) y que se han hecho públicas dos propuestas de reforma integral del proceso penal español en las que se abordaban tales cuestiones.

The main aim of this paper is to analyze the procedural issues that arise in the implementation of the criminal mediation. The benefits of criminal mediation and restorative justice are unquestionable. Nevertheless, in the Spanish legal system there are no satisfactory statutory provisions to answer decisive questions, such as the kinds of crimes can be diverted to mediation, the competent authority to adopt this decision, the procedural phase in which the mediation should take place or the way to incorporate the results of the mediation process in the judicial proceedings. The aforementioned uncertainty whiting the Spanish legal system is difficult to understand considering that Directive 2012/29/UE on the protections of victims of crime has been transposed into the Spanish legal system (Act 4/2015) and taking into account that two comprehensive proposals to reform the Spanish criminal proceedings have been published, in which the questions above had been solved.
