A interdependência ou a conflitualidade entre o direito ao meio ambiente ecologicamente equilibrado e o direito à cultura na sociedade contemporânea

    Considering that the Brazilian Federal Constitution regulates the right to culture and the ecologically balanced environment as fundamental rights, it is necessary to ask which measures are interdependent among themselves? Thus, the method of approach was the deductive method and the monographic procedure were used to answer the research question. In addition, the article was divided into three chapters, the first two, respectively, studying the right to culture and the ecologically balanced environment as fundamental rights, and in the last one, by analyzing the existing interdependence or conflict relation between them. From this, it has been found that there is no watertight relationship of connection or shock between the right to culture and the ecologically balanced environment. This act will depend on the legal relationship being analyzed, due to the fact that some of them are in a situation of interdependence and, in others, in latent conflict.

    Tendo em vista que a Constituição Federal brasileira elenca o direito à cultura e ao meio ambiente ecologicamente equilibrado como sendo direitos fundamentais, cabe perquirir em que medida tais são interdependentes entre si? Assim, para responder ao problema de pesquisa posto, utilizou-se como método de abordagem o dedutivo e como método de procedimento o monográfico. Ademais, dividiu-se o artigo em três capítulos, tratando-se nos dois primeiros, respectivamente, do direito à cultura e ao meio ambiente ecologicamente equilibrado enquanto direitos fundamentais e, no último, fazendose uma análise da interdependência ou relação de conflitualidade existente entre ambos. A partir disso, verificouse que não existe entre o direito à cultura e ao meio ambiente ecologicamente equilibrado uma relação estanque de conexão ou de choque. Tal dependerá da relação jurídica que está sendo analisada, pois, em algumas esses encontramse em situação de interdependência e, em outras, em conflitualidade latente.
