  • The enforcement of an annulled arbitral award is a polemic topic, but there is jurisprudence inclined to favor of this. A tour for the jurisprudence of France, The United States, Netherlands and Spain allows to see it. Nevertheless, the Comparative Jurisprudence is not uniform.

    The grounds for invalidity of an arbitral award can be different in Comparative Law.

    In this context, the invalidity of the arbitral awards by ignorance/unknowing of the Human Rights raises an interesting question: Must the other States assume this situation?. The 1958´s New York Convention allows the protection of the Human Rights and the bilateral relations among the States.
