Resumen de Movilidades humanas internacionales: tensiones y coincidencias en discursos juridicos

El propósito de este artículo es abordar el tema de los procesos de movilidad internacional de las personas y su relación con el reconocimiento de derechos. Para ello, se analizan los resultados de entrevistas semiestructuradas, realizadas a miembros del sistema judicial argentino (particularmente a aquellos que ofician como defensores de derechos de extranjeros y otros operadores judiciales) así como también algunos cambios normativos a nivel nacional. Entre los resultados relevantes, cabe mencionar que se evidencia que existen una serie de obstáculos simbólicos y materiales (vinculados con representaciones sociales construidas históricamente sobre los extranjeros) que dificultan, al interior del sistema judicial, una concepción de los migrantes, como sujetos de derechos,que sea plenamente universal.

This paper aims to approach the topic of the international mobility processes of the persons and its relation with the rights recognition. For it, there are analyzed the results of semistructured interviews, realized to members of the Argentine judicial system(particularly those who officiate as defenders of foreigners’ rights and other judicial operators)and also some normative changes at the national level. Between the main results, it is important to mention the evidence that there exists a series of symbolic and material obstacles (linked with social representations constructed historically on the foreigners) that make difficult, to the interior of the judicial system, a conception of the migrants, like subjects of rights, entirely universal.
