Resumen de Incumplimiento de un contrato de arrendamiento de servicios a finales del siglo XVIII (litigio procesal entre dos hermanos gallegos, albañiles, trabajadores en miróbriga)

El 6 de julio de 1773, fallece en Miróbriga un gallego, natural de San Miguel de Tabagón (obispado de Tuy. Pontevedra), y maestro de albañilería, que tenía dos hijos en su compañía. Uno de ellos, con 18 años cumplidos, ya oficial, pasa a maestro en el arte, y mantiene al hermano menor, con catorce años, en su grupo de trabajadores, bajo su gobierno y dirección hasta 1780, en cuyo año contrajo matrimonio, y le reclama extrajudicialmente que, desde el óbito del padre común, le pertenece una parte de las herramientas del difunto y el salario devengado.
El hermano mayor se niega a ello, y dicho hermano insatisfecho, insta, ante el juez mirobrigense, una acción judicial, fechada en noviembre de 1789. El alcalde mayor condena al hermano a su abono de salarios, correspondientes a seis años y medio, viniendo confirmada sustancialmente la sentencia condenatoria en apelación, por parte de la Real chancillería de Valladolid

On July 6, 1773, Juan Martínez Nieto, a native of San Miguel de Tabagón (bishopric of Tuy, Pontevedra) died in Miróbriga, and a master of masonry, who had two children in his company. One of them, with 18 years old, already an officer, becomes a master in art, and keeps the younger brother, with fourteen years, in his group of workers, under his government and direction until 1780, in which year he married, and he extrajudicially claims that, since the decease of the common father, part of the tools of the deceased and the salary accrued belongs to him. The older brother refuses to do so, and said dissatisfied brother, urges, before the judge mirobrigense, a judicial action, dated November 1789. The condemns the brother to his payment of wages, corresponding to six and a half years, coming substantially confirmed on appeal, by the Royal Chancery of Valladolid
