La solidaridad impropia de deudores. Justificación, admisibilidad y futuro

    Cuando hay dos o más deudores, el Código civil español considera que la mancomunidad es la regla general, y la solidaridad, la excepción. Sin embargo, cuando dos o más personas han causado el mismo daño, las sentencias los condenan como obligados solidarios, siempre que, según dicen, no haya sido posible determinar sus respectivas participaciones en la producción de dicho daño; a esta figura se le llama «solidaridad impropia». Según esas resoluciones, la protección de las víctimas justifica esta figura, y entienden que es admisible porque la regla general de la mancomunidad no se aplica en este caso. Considero que tanto las mencionadas justificación y admisibilidad son cuestionables. Por otra parte, parece que en el futuro, el Derecho civil español recogerá la mencionada figura, teniendo en cuenta las propuestas legislativas nacionales y europeas.

    When there are two or more debtors, the Spanish Civil Code considers that joint liability is the general rule, and several liability is the exception. Nevertheless, when two or more particular persons have caused the same damage, the sentences convict them as several debtors, if it wouldn’t have been possible to determine their participation in order to produce that damage; «improper several liability» is the name of this form. According to that sentences, the protection of victims justifies this form, and consider that it is admissible because the general rule of joint liability doesn’t enforce in this case. In my opinion, both of them, justification and admissibility, are questionable. On the other hand, it seems that in the future, Spanish Civil Law will include the mentioned form, bearing in mind the national and european legislative proposals.
