Resumen de La justícia i la mediació: dues figures diverses de I'activitat comunicativa

La finalidad de este artículo es poner de manifiesto las profundas diferencias de lógica interna, de procedimiento y de desenlace que presuponen un juicio y una mediación, a partir de las reflexiones sobre la Justicia del filósofo francés Paul Ricoeur y sobre la Mediación de Jean-François Six, presidente del centro National de la Médiation de París. Trata de mostrar que tanto la justicia como la mediación tienen su campo de acción propio y su finalidad específica y no pueden reducirse a dos fenómenos sociales intercambiables o substituibles sin más consideración. La justicia y la mediación han de poder colaborar franca y lealmente, pero cada una desde su propio terreno. El reto que hoy tenemos planteado los mediadores es el de mostrar claramente a la sociedad la especificidad y originalidad de nuestra acción comunicativa y el espacio que queremos y podemos cubrir para no devaluarla ni hacerla confusa. Los mediadores no somos ni jueces light ni simples delegados de la judicatura, porque la justicia y la mediación corresponden a dos formas o figuras diversas de la actividad comunicativa humana.

The purpose of this essay is to outline the deep differences in exposition, proceeding and resolution between a 'judgement' and a 'mediation', after the analysis on Justice of the French philosopher Paul Ricoeur and the works on Mediation of Jean-François Six, Head of the Centre National de la Médiation de Paris. It tries to show that justice and mediation have their own specific field of action and their own separated aims. They are not mere social phenomena that we could let pass by or change without consideration. It says that justice and mediation must work together, faithfully and frankly, but each one on its own field. The challenge that we mediators must face nowadays regarding the society in order not to make it more condused or valuableless: we must show the specificity and the originality of our communicative action and the space that we would intend to cover. We mediators are not light judges nor mere representatives of justice, since jutice and mediation belong to two different activities in the human communication.
