Interfaz urbano-forestal e incendios forestales: regulación legal en España

    El artículo analiza la situación jurídica en España de la prevención y defensa de las edificaciones frente a los incendios forestales, en particular en la llamada interfaz urbano-forestal (IUF), que se define como la zona en la que el terreno edificado entra en contacto con el monte. Primero se analizan los problemas jurídicos (competenciales y prácticos) a los que se enfrenta la regulación en materia de IUF, tras lo cual se revisan las disposiciones aplicables en la normativa de la Unión Europea y en las normas estatales (forestales, de edificación, de urbanismo y ordenación del territorio, y de protección civil). Finalmente, se examinan las soluciones que han ofrecido las legislaciones de cuatro Comunidades Autónomas (Andalucía, Aragón, Cataluña y Galicia). Se concluye, entre otros aspectos, que la regulación de la IUF está dispersa en muchas legislaciones, de distinto ámbito territorial, y que resulta difícil determinar las obligaciones de los propietarios de terrenos edificados en relación con la prevención de incendios.

    This paper analyzes the legal situation in Spain of the prevention and defense of buildings against wildfires, particularly in the Wildland/Urban Interface (WUI), defined as the area in which the built-up land comes into contact with the woodland. First, it analyzes the legal problems (competencial and practical ones) faced by the WUI regulation, and then it reviews the applicable provisions included in the European Union regulations and in the State laws (forests and natural environment law, building law, urban planning and civil defence). Finally, the solutions offered by the legislation of four regional governments (Andalusia, Aragon, Catalonia and Galicia) are examined. It concludes, among other aspects, that the WUI regulation is dispersed in a lot of legislations, and with different territorial scope, and that it is difficult to determine the obligations of the owners of the buildings in relation to fire protection measures.
