Resumen de Lucha individual de una esclava en tiempos de la Independencia Nacional Paraguaya

El presente estudio constituye el análisis de una demanda judicial iniciada por una esclava mulata en Asunción, Paraguay, en 1812, para obtener su libertad, mientras el país se encontraba inmerso en su proceso de independencia nacional de España y de Buenos Aires. Los valores de independencia y libertad enunciados en los discursos oficiales no incluían, sin embargo, a todos los habitantes del territorio paraguayo, entre quienes había una cantidad considerable de esclavos negros. A su condición de esclava, la demandante sumó otros factores en contra, los de ser una mujer y analfabeta. Durante la investigación se intenta ver cómo funcionaba el sistema judicial paraguayo a inicios del siglo XIX, específicamente en relación a la integrante de un estamento discriminado legalmente, como es el de la esclavitud, cuyo contexto histórico y sociocultural también se describe. Se reflexiona, asimismo, acerca de cuestiones como la rebeldía, las instituciones, la posición de un individuo frente a ellas y dentro de las mismas, así como las lecciones que se podría tomar de todo esto, desde la comparación con los tiempos actuales en el Paraguay.

This study constitutes the analysis of a law suit promoted by a mulatto slave woman in Asunción, Paraguay, in 1812, to obtain her freedom, while the country was immersed in its independence process from Spain and Buenos Aires. Notwithstanding the values of independence and liberty that were proclaimed in the official speeches of the time, they did not include all of the inhabitants of the Paraguayan territory, among which there was a considerable number of black slaves. The plaintiff, being a slave, faced yet other factors working against her, those of being a woman, and an illiterate person. During this research, the aim was to observe how the Paraguayan justice system of the beginnings of the XIX century operated, specifically in its relation to one member of a legally discriminated social class, as is that of slavery, of which its historical and sociocultural context is also described. There is, furthermore, an attempt of a critical reflection on issues such as rebellion, institutions, the position of individuals towards and within them and the lessons that might be learned, from the perspective of the contemporary times in Paraguay.
