    This article offers a general overview of cohabitation in Portugal. It analyses the legal definition of cohabitation and the requirements of its legal effects. The author claims that cohabitation should be regulated according to the right of individuals to choose the way to live their own life, that is constitutionally protected in Portugal. Furthermore, it questions about the intervention of the legislator, mainly if it not excessive in the field of family home protection.

    Este texto pretende oferecer uma visão geral sobre a união de facto em Portugal, começando por concretizar a figura da coabitação de duas pessoas em condições análogas às dos cônjuges e por identificar quais são os requisitos para que aquela possa produzir efeitos. Assumindo que a união de facto é uma manifestação do direito do indivíduo, constitucionalmente protegido, ao desenvolvimento da sua personalidade, apreciar-se-ão os efeitos conferidos pela ordem jurídica, bem como a legitimidade da intervenção do legislador e a medida dessa intervenção, sobretudo no âmbito da casa de morada de família.
