Experiências constitucionais no Uruguai de 1830 e no Rio Grande do Sul de 1843: um ensaio de liberalismo caudilho

    O objetivo do artigo consiste em analisar historicamente o projeto de Constituição Rio-Grandense (1843) e a Constituição Uruguaia (1830). Os dois documentos legais espelharam em termos jurídicos um contexto histórico particular da região rio-grandense e uruguaia e refletiram o que denominamos de liberalismo caudilho. Isto é, um liberalismo adaptado ao interesse das elites rurais que lideraram a Revolução Farroupilha e o processo de independência do Uruguai. Em uma perspectiva comparada, objetivamos localizar os pontos de encontro e desencontro entre os ideais expostos pelos revoltosos farroupilhas e uruguaios considerado o liberalismo das primeiras décadas do século XIX

    The objective of this article is to analyze historically the Rio Grande draft Constitution (1843) and the Uruguayan Constitution (1830). The two legal documents mirrored in legal terms a particular historical context of Rio Grande do Sul region and Uruguay and reflected what we call liberalism caudillo. That is, liberalism adapted to the interests of rural elites who led the Farroupilha Revolution and the Uruguayan independence process. In a comparative perspective, we aim to find the meeting points and mismatch between the ideals exhibited by farroupilhas and Uruguayan rebels considered the liberalism of the early nineteenth century
