Con base en el estudio comparado de los casos de restitución de los Mármoles del Partenón, promovido por Grecia y del Patrimonio Cultural Quimbaya en Colombia, el presente artículo sustenta la tesis de que aunque el derecho para la restitución de bienes culturales se encuentra en etapa inicial de consolidación y, por tanto, de seguro tendrá muchos desarrollos en el futuro, existen en la actualidad bases jurídicas suficientes para hacer efectiva esa restitución, necesaria para realizar el legítimo derecho de los pueblos a conocer, apreciar, disfrutar y difundir el patrimonio expresión de su identidad, de su cultura y de su historia.
Based on the comparative study of the restitution cases of the Parthenon marbles, promoted by Greece and of Quimbayan cultural patrimony in Colombia, this article upholds the thesis that although the right for the restitution of cultural goods is in its initial stage of consolidation and for this reason it will surely have many developments in the future, in actuality sufficient legal bases exists to make restitution effective. This is necessary to enact people’s legitimate right to know, appreciate, enjoy and spread the patrimony that is an expression of their identity, culture, and history.
