En este artículo se abordan todas aquellasacciones que, encaminadas a zanjarlas brechas notoriamente existentesen la sociedad por atentar contra elprincipio-derecho fundamental de laigualdad, tienen cabida en la actividadcontractual del Estado en Colombia; suorigen y desarrollo histórico, evoluciónnormativa a la luz de la Constitución de1991, pero principalmente el desarrollojurisprudencial de la mano de la CorteConstitucional y algunas medidas y casospuntuales en torno a esta discriminaciónpositiva, son la motivación del presentetrabajo investigativo.

All those actions focused to finish the big differences found in the society, which crash with the principle – fundamental riqht of equality, have place in the contracting activity of the Colombian State;
their historic origin, the normative evolution in the Colombian Constitution of 1991, but principally the jurisprudential development with the Constitutional Court and some of these significant measures and actions around this positive discrimination, are the motivation of the present investigative work.
