    The rough way of environmental NGOs in international litigations. Traditionally, public international law has always reserved a marginal role for non-state actors. However, the rise of these actors in the negotiating fora, both in the field of human rights and in the field of international environmental law, as well as their essential function in the implementation of the international public law, invites us to reflect on the evolution of their role in interstate disputes. Even if the breaches opened in the rules of the disputes, which would allow them to access the cour- troom on the international scene, remain unobtrusive, the scope of such an opening of international disputes to non-governmental actors could become essential for a better effectiveness and efficiency of the international environmental law.

    Traditionnellement, le droit international public a toujours réservé un rôle marginal aux acteurs non gouvernementaux. Toutefois, la montée en puissance de ces acteurs dans les enceintes de négociations, aussi bien dans le domaine des droits de l’Homme que dans le domaine du droit international de l’environnement, ainsi que leur fonction essentielle dans la mise en œuvre du droit international public nous invitent à réfléchir à l’évolution de leur rôle au sein des contentieux interétatiques. Même si les brèches ouvertes dans les procédures contentieuses, qui leur permettraient d’accéder au prétoire sur la scène internationale, demeurent encore discrètes, la portée d’une telle ouverture du contentieux international aux acteurs non gouvernementaux pourrait devenir essentielle pour une meilleure effectivité et efficacité du droit international de l’environnement.
