The Ministry of the Environment is regularly confronted with appeals by environmental protection associations, which challenge administrative acts issued by central or decentralised services, as the associations consider that the Ministry does not provide sufficient environmental protection.
The Ministry of the Environment is in a particular position. On the one hand, it is responsible within the Government for ensuring the protection of environmental interests, and on the other hand, it must take into account the opinions of other ministries, where appropriate by applying inter-ministerial arbitrations, including those ruled against it. In this context, the litigation initiated by the associations appears as a stimulus, as it makes it possible to advance the cause of environmental protection defended by the Ministry, but can also give rise to difficulties.
Le ministère chargé de l’environnement est régulièrement confronté à des recours formés par les associations de protection de l’environnement, qui contestent les actes administratifs édictés par les services centraux ou déconcentrés, les associations estimant que le ministère n’assure pas suffisamment la protection de l’environnement.
Le ministère de l’Environnement se trouve en effet dans une situation particulière. D’une part, il est chargé, au sein du Gouvernement, d’assurer la protection des intérêts de l’environnement, d’autre part, il doit tenir compte des avis des autres ministères, le cas échéant en déclinant les arbitrages interministériels, y compris ceux rendus en sa défaveur. Dans ce contexte, le contentieux initié par les associations apparaît alors comme un aiguillon stimulant, en ce qu’il permet de faire avancer la cause de la protection de l’environnement défendue par le ministère, mais susceptible parfois de créer quelques difficultés.
