Resumen de Trata y tráfico de personas: perspectivas y propuestas para un abordaje integral de la problemática en la República Argentina

En las últimas décadas, la Trata y el Tráfico de Personas han ganado centralidad tanto en los foros internacionales y en el discurso mediático y social, como en los sistemas y códigos penales de diversos países.
Empero, aún resulta sumamente dificultoso obtener información completa y cuantificar la magnitud de este flagelo. Paralelamente, existen serias limitaciones para captar la complejidad de este fenómeno en su totalidad visto que, entre otras cuestiones, se trata de una problemática que engloba una multiplicidad de dimensiones y en su realización, generalmente, se incluyen una serie de situaciones delictuales relacionadas.
En esta ponencia, nos proponemos echar luz sobre el concepto deteniéndonos en el marco legal y en las características particulares que adquiere el delito en nuestro país; para finalizar proponiendo la adopción de un abordaje integral que contribuya al cuidado y protección de sus víctimas y a la prevención y erradicación de la Trata y el Tráfico de Personas.

In recent decades, Smuggling and Human Trafficking have gained a central importance both in international forums, in the media and social discourse, and in the criminal law of several countries.
However, it is still particularly difficult to get comprehensive information and to quantify the extent of the scourge of Smuggling and Human Trafficking.
At the same time, considering its multi-faceted nature and the related offences that are involved in this crime, there are serious limitations to grasp the phenomenon in all its complexity.
In this paper, we aim to shed light on the different meanings of the concept; as well as to go in-depth on the legal framework and the particular characteristics that the crime acquires in our country. Finally, we will propose the adoption of a comprehensive approach that promotes specific projects aiming at the protection and care for the victims and at the prevention and erradication of Smuggling and Human Trafficking.
