    Observando lo que sucede en las economías más avanzadas del mundo, se considera posible afirmar que la transformación tecnológica y digital tenga dos sinónimos para el futuro: blockchain y contratos inteligentes. Estas tecnologías permiten transferir valores, bienes y derechos sin el control de las instituciones centrales y de manera totalmente automática. La comprobación, el monitoreo y la autenticidad de estas transacciones están garantizados por la propia cadena de bloques. El objetivo del presente ensayo, aunque estando todavía a la espera de una intervención reguladora a nivel comunitario, es describir los aspectos técnicos, legales y jurídicos más relevantes de estas tecnologías, tratando de comprender, por un lado, si y como las mismas podrían plantear complicaciones tanto con la legislación europea como con la española y, por el otro cuales podrían ser los efectos que los contratos inteligentes aplicados a la tecnología blockchain producirán en el futuro inmediato.

    Observing what happens in the most advanced economies in the world, it is considered possible to affirm that the technological and digital transformation has two synonyms for the future: blockchain and smart contracts. These technologies allow the transfer of values, goods and rights without the control of the central institutions and in a totally automatic way. The verification, monitoring and authenticity of these transactions are guaranteed by the blockchain itself. The objective of this essay, although still waiting for a regulatory intervention at the Community level, is to describe the most relevant technical, legal and juridical aspects of these technologies, trying to understand, on the one hand, whether and how they could raise complications both with European and Spanish legislation and, on the other hand, the effects that smart contracts applied to blockchain technology will produce in the immediate future.
