En el presente documento se hace una reflexión acerca de los efectos colaterales que la protección de los derechos políticos puede generar en contextos de diversidad cultural, fundamentalmente la ilegitimidad de la autoridad municipal. Se toma como referencia el juicio SUP-JDC-1654/2016 (caso Chenalhó), para justificar por qué se consideraron diferentes elementos interculturales en el dictado de una sentencia definitiva, siempre y cuando el objetivo de la autoridad judicial electoral realmente sea resolver el conflicto, es decir, impulsar la paz social en los pueblos originarios y en todo el Estado mexicano

In this document, a reflection is made about the collateral effects that the protection of political rights can generate in contexts of cultural diversity, fundamentally the illegitimacy of the municipal authority. Reference is made to the judgment for the protection of the electoral political rights of the citizen SUP-JDC-1654/2016 (case of Chenalhó) to justify the importance of considering different intercultural elements in the issuance of a definitive sentence, as long as the objective of the electoral judicial authority is to really solve the conflict, that is to say to impel the social peace in the original towns and in all the Mexican State
