    Un bilancio, a trent’anni dall’entrata in vigore del codice di rito penale, denuncia come, in materia di intercettazioni, a fronte di molte riforme “annunciate”, poche sono state quelle “attuate” e molte quelle “mancate”, oltre quella “sospesa” dal d.lgs. n. 216/2017. Ma su molti aspetti di questa disciplina, l’interpretazione giurisprudenziale ha stravolto le poche riforme “attuate”, che quindi devono considerarsi di fatto “fallite”.

    A balance, made thirty years after the criminal procedure code entered into force, shows how, with regard to wiretapping, despite many "announced" reforms, only few of them have been "implemented" and many have been "missed", in addition to the one "suspended" by the legislative decree n. 216/2017.

    But on many aspects of this discipline, case-law interpretations have upset the few "implemented" reforms, which therefore must be considered de facto "failed"
