Resumen de Equality of third country nationals (TCNS) twenty years after tampere: EU and ECHR protection

  Este artículo reflexiona sobre la exclusión de los inmigrantes que residen legalmente en la UE de la protección por motivos de nacionalidad. Al abordar esta cuestión, el trabajo analiza el desarrollo del principio de no discriminación basada en la nacionalidad y la raza y el marco jurídico de las cláusulas de igualdad previstas en las Directivas de migración que conceden igualdad de trato a categorías específicas de nacionales de países no europeos. El nivel de protección de la legislación de la UE se compara con el del artículo. 14 del CEDH para investigar si, veinte años después de las conclusiones de Tampere, la UE sigue apoyando la doctrina del CEDH en lo que se refiere a la igualdad de trato de los nacionales de terceros países. En el documento se examinan las diferencias de protección entre los dos sistemas. Asimismo, se analiza si las diferencias están relacionadas principalmente con el enfoque fragmentado del legislador de la UE que regula el estatuto de los nacionales de países no europeos.   This article reflects on the exclusion of legally residing migrants within the EU from protection on the ground of nationality. In addressing this question, the work analyses the development of the principle of non-discrimination based on nationality and race and the legal framework of equality clauses provided in the Migration Directives granting equality of treatment to specific categories of TCNs. The standard of protection under EU law will be compared with that under art. 14 of the ECHR in order to investigate whether twenty years after the Tampere Conclusions the EU is still lying behind the ECHR as to the equality of treatment of TCNs. The paper considers the differences of protection under the two systems. It then questions whether the differences are mainly related to the fragmented approach of the EU legislature regulating the status of TCNs. It concludes making suggestions on how to overcome the resulting gap
