  El artículo muestra que la regulación legal de la violación y las decisiones judiciales que la aplican están cruzadas por consideraciones culturales. Entre ellas, la lucha por el reconocimiento de las mujeres como agentes sexuales autónomas es particularmente importante y valerse del nomen iuris “violación” parece decisivo en su reconocimiento como tales.

  The article shows that the legal regulation of rape and the judicial decisions that apply it are crossed by cultural considerations. Among them, the struggle for the recognition of women as autonomous sexual agents is particularly important and the use of the nomen iuris “rape” seems decisive in their recognition as such.
