Resumen de La contribución de la jurisprudencia al endurecimiento de la respuesta a los menores infractores

Las sucesivas reformas de la Ley de responsabilidad penal del menor han endurecido la respuesta a los menores infractores. Este trabajo tratará de acreditar que la jurisprudencia recaída sobre algunos aspectos ha contribuido a que los menores que cometen delitos reciban una respuesta más dura. Para ello se ha efectuado una selección de sentencias sobre algunas temáticas que tienen en común asegurar la condena o una sanción más grave, contraviniendo los fines perseguidos por el sistema de justicia juvenil e incluso en ocasiones principios constitucionales.

The criminal response to juvenile offenders has been progressively toughened by succesive amendments in the Organic Law on the Criminal Liability of Minors. This paper attempts to show that the case law on some issues has contributed to increase the severity of that response. For this purpose, rulings on certain items have been gathered and selected where securing either conviction or a more severe punishment in breach of the goals pursued by the juvenile justice system, and sometimes even in violation of constitutional principles, is common ground.
