El presente trabajo gira en torno a la pregunta: ¿Constituye el fenómeno de cosa juzgada un obstáculo en el desarrollo del principio de progresividad de los derechos? ¿En qué casos se ha constituido una regresión de los derechos inefectiva sujeta al fenómeno de cosa juzgada? Busca analizar el principio de progresividad de los derechos, a la luz de la Jurisprudencia constitucional y de los principios propios del Estado Social de derecho, y establecer en qué casos y bajo qué argumentos se ha constituido una regresión no justificada de los derechos, que no vuelve a revisarse por aplicación de la cosa juzgada, determinando como instrumento argumentativo este trabajo que tendrá un desarrollo dialéctico.

The present paper revolves around the question: Is the phenomenon of res judicata an obstacle in the development of the principle of the escalation of rights? In what cases has a regression of the property rights of the subject of the res judicata been constituted? It seeks to analyze the principle of progressivity of rights, in the light of constitutional jurisprudence and the principles proper to the Social State of law, and to establish in what cases and under what arguments a regression has been constituted without justification of the rights, which do not It revisits again by the application of res judicata, determining as an argumentative instrument this work that has a dialectical development.
