Resumen de Obstáculos a la regulación de las profesiones en el deporte

La necesidad de proteger la salud y la seguridad de los consumidores de servicios deportivos ha llevado a varias Comunidades Autónomas a regular el marco del ejercicio de las profesiones en el deporte. Esta iniciativa se ha encontrado con la oposición de algunos sectores y con obstáculos derivados de la normativa existente y del propio mercado de trabajo. Este artículo tiene su origen en la ponencia que fue presentada en el Congreso Estatal de ordenación profesional de la Educación Física y del Deporte, que tuvo lugar los días 15 y 16 de noviembre de 2018 en Santa Lucía de Tirajana (Gran Canaria, Las Palmas).
En la situación actual es necesario un marco normativo estatal que identifique y armonice de forma ordenada y proporcional el acceso y ejercicio profesional. Las dificultades serán muchas y diversas. El sector del deporte en España es complejo y dinámico, en él concurren todo tipo de formaciones (regladas y no regladas), e incluso muchas personas trabajan sin una formación específica, los sueldos son precarios y los datos hablan de la existencia de mucha economía sumergida. La mayoría de empresarios manifiestan que no se necesita ningún tipo de regulación, que las profesiones ya existen y que el mercado es capaz de autorregular sus necesidades.
La Unión Europea condiciona el alcance de la regulación del ejercicio de las profesiones del deporte en el territorio nacional al velar por el principio de libre circulación de ciudadanos y de servicios. y la unidad de mercado se fundamenta en la libre circulación y establecimiento de los operadores económicos, en la libre circulación de servicios, y en la igualdad de las condiciones de ejercicio de la actividad económica, sin que ninguna autoridad pueda obstaculizarla.

The need to protect the health and safety of consumers of sports services has led to several Autonomous Communities to regulate the framework of the exercise of the professions in sport. This initiative has met with the opposition of some sectors and with obstacles derived from the existing regulations and from the labor market itself. This article has its origin in the talk that was presented at the National Congress of professional organization of Physical Education and Sports, which took place on 15 and 16 November 2018 in Santa Lucia de Tirajana (Gran Canaria, Las Palmas).
In the current situation, it is necessary a state regulatory framework that identifies and harmonizes, in an orderly and proportional manner, the access and professional practice. The difficulties will be many and diverse. The sport sector in Spain is complex and dynamic, in which all types of training (regulated and non-regulated), and even many people work without specific training, salaries are precarious and the data speak of the existence of much submerged economy. The majority of businessmen state that no type of regulation is needed, that the professions already exist and that the market is capable of self-regulating their needs.
The European Union determines the scope of the regulation of the exercise of the professions of sport in the national territory by ensuring the principle of free movement of citizens and services. And the market unit is based on the free circulation and establishment of economic operators, on the free circulation of services, and on equal conditions for the exercise of economic activity, without any authority being able to hinder it.
