Resumen de Reflexiones en torno al nuevo constitucionalismo latinoamericano

El nuevo constitucionalismo latinoamericano (NCL) es un fenómeno jurídico que busca dar cuenta de lo sucedido en los procesos constituyentes desarrollados desde los finales del siglo xx hasta nuestros días. Asimismo, se trata de una corriente constitucional que se encuentra en construcción. No obstante, es posible destacar algunas notas en común que caracterizan a las constituciones de Venezuela, Ecuador y Bolivia. Sin duda alguna, lo anterior será determinante para quienes buscamos indagar y proporcionar razones del cómo se han venido gestando los nuevos ordenamientos jurídicos que han propiciado una serie de reflexiones y debates poco homogéneos. Es importante mencionar que nos encontramos con un fenómeno en periodo de construcción doctrinal. Sin embargo, consideramos que el NCL es un excelente laboratorio de pruebas que permite seguir explorando alternativas en torno a la deuda democrática que se la ha demandado por tanto tiempo al constitucionalismo. Por tanto, la pertinencia de analizar los alcances de los diseños institucionales que proponen las constituciones del NCL que intentan solventar las carencias democráticas que hoy en día las constituciones modernas no han podido remediar. En este orden de ideas, las constituciones del NCL son entonces la hoja de ruta que permite una vía de análisis distinta con respecto a otras corrientes como el constitucionalismo moderno o neoconstitucionalismo que, dicho sea de paso, son fuente de controversias y dudas. The new Latin American constitutionalism (NCL) is a legal phenomenon that seeks to account for what happened in the constituent processes developed from the end of the twentieth century to the present day. It is also a constitutional current under construction. Nevertheless, it is possible to highlight some common notes that characterize the constitutions of Venezuela, Ecuador and Bolivia. Without any doubt, this will be decisive for those of us who seek to investigate and provide reasons for the development of the new legal systems that have given rise to a series of unconventional reflections and debates. It is important to mention that we find a phenomenon in a period of doctrinal construction. However, we consider that the NCL is an excellent test laboratory that allows us to continue exploring alternatives around the democratic debt that has been demanded of constitutionalism for so long. Therefore, the relevance of analyzing the scope of the institutional designs proposed by the constitutions of the NCL that try to solve the democratic deficiencies that modern constitutions have not been able to remedy today. In this order of ideas, the constitutions of the NCL are then the road map that allows a different way of analysis with respect to other currents such as modern constitutionalism or neoconstitutionalism that, Incidentally, they are a source of controversy and doubt.
