Resumen de Menores y redes sociales: nuevos tipos penales y responsabilidad penal

  La proliferación del uso de redes sociales e internet por parte de menores, y adolescentes, nos han puesto ante un nuevo escenario en lo que la lucha contra la criminalidad se refiere. Así, a los tradicionales problemas que la investigación de todo delito cometido en la red conlleva, se han unido cuestiones penológicas, éticas e, incluso, sociales. Si los delitos cometidos por menores contra menores en la red deben tener idéntica respuesta penal; si resulta posible acceder, o no, a los dispositivos informáticos de menores de edad sin su consentimiento; o si es posible aplicar soluciones extrajudiciales a este tipo de situaciones, son algunas de las cuestiones que serán resueltas en el presente artículo.

  The proliferation of the use of social networks and the Internet by minors and adolescents has put us before a new scenario in the fight against criminality. Thus, to the traditional problems that the investigation of any crime perpetrated online entails, penological, ethical and even social issues have been added. Whether offences perpetrated by minors against minors on the Internet should have the same criminal response; whether it is possible to access or not to the computer devices of minors without their consent; whether it is possible to apply out-of-court settlements to this type of situation, are some of the issues that will be dealt with in this article.
