PEl hecho de que no exista comunicación alguna entre el menor y el progenitor no custodio durante un periodo prolongado de tiempo y que, además, este no abone puntual y voluntariamente las pensiones alimenticias establecidas en favor de su hijo sin causa justificada, supone un incumplimiento grave y reiterado de las obligaciones inherentes a la patria potestad. Ello provoca que quede afectada la relación paterno-filial de manera seria y justifica que proceda, en beneficio del menor, la pérdida de la patria potestad por parte del progenitor incumplidor.

The fact that there is no communication between the minor child and the non-custodial parent for a prolonged period of time and that, furthermore, the parent does not pay punctually and voluntarily the support payments established in favor of his or her child without just cause, is a serious and repeated violation of the obligations inherent to parental authority. This causes the parent-child relationship to be seriously affected and justifies, for the benefit of the child, the loss of parental authority on the part of the non-compliant parent.
