El presente trabajo tiene por objeto analizar los problemas relacionados con la determinación del proceso adecuado tanto por razón de la materia como por razón de la cuantía en el artículo 254 LEC, estudiando los distintos párrafos de dicho artículo, y la actuación de oficio que para la correcta tramitación procesal debe impulsar el órgano judicial, y específicamente el Letrado de la Administración de Justicia.

The purpose of this paper is to analyse the problems related to the determination of the appropriate proceedings for both the subject matter and the amount involved in the claim in Section 254 of the Civil Procedural Act (LEC), studying the different paragraphs of that section, and the action by operation at law that the judicial body, and specifically the lawyer of the Administration of Justice, must promote for the correct procedural processing.
