Resumen de La legitimación y la excepción de litisdependencia de un proceso colectivo sobre el individual posterior

Este trabajo de investigación analiza el efecto que una acción colectiva de cesación puede tener sobre la posterior acción individual del mismo tipo, para determinar si cabe entender que estamos ante la litispendencia alegada por las entidades bancarias o bien si dicha preclusión, tal y como entiende el Tribunal de Justicia de la Unión Europea, conlleva una afectación a la tutela judicial efectiva de los consumidores afectados. La solución a dicha cuestión requiere estudiar los intereses subyacentes a la acción ejercitada y hacer especial hincapié en su titularidad para ver si concurre la identidad subjetiva que exige la litispendencia.

This article analyses the effect that a collective injunction may have towards the posterior injunction that the individual consumer brings in order to determine if there is the lis pendence pretended by the banking entities or if that preclusion may affect the access to justice of the consumer – as the European Court of Justice understands. The solution to this problem requires a deep study of the underlying interests to the action brought, placing the accent on their titularity, as it is the key to determine if there is the identity of subject that lis pendence requires.
