Resumen de La libertad de creación: apuntes sobre una libertad relativamente desconocida

El presente trabajo gira en torno a la libertad de creación, a su contenido esencial, a sus límites y a los principales conflictos que se pueden producir, en la práctica, con otros derechos. La libertad de creación debe ser diferenciada de las libertades de expresión y de información, pese al lazo de parentesco evidente, y los posibles conflictos con el derecho al honor, a la intimidad o la realización de posibles tipos penales, merecen un tratamiento adecuado y propio. Alguna Sentencia del Tribunal Constitucional y de otros órganos jurisdiccionales pueden ayudarnos a reflexionar sobre el tema.

The present work is about teh freedom of creation, its essential content, its limits and the main conflicts that can occur in practice with another rights. The freedom of creation, despite the obvious relationship, must be differentiated from the freedom of expressions and the freedom of expression and honor, privacy or the realization of posible conflicts with the right of honor, privacy or the realization of possble criminal types, deserve a proper treatment. Some Judgment of the Spanish Constitucional Court and the other jurisdictional Courts can help us reflect on the issue.
