Resumen de Riesgos en la aplicación del principio precautorio en responsabilidad civil y ambiental

RESUMEN: Este artículoculo revisa la noción de riesgo; examina los principios preventivo y precautorio confrontándolos con el deber de cuidado y el nexo causal; y analiza el impacto del principio precautorio en recientes fallos judiciales, nacionales y extranjeros, sobre responsabilidad civil y ambiental. Argumenta que el intento de reinterpretar la responsabilidad civil y ambiental a la luz del principio precautorio conlleva el riesgo de distorsionar la esencia de la culpa y la causalidad, lo que puede conducir a imponer una responsabilidad estricta sin base legal.

ABSTRACT: This article reviews the notion of risk; it assesses the preventive and the precautionary principles; it compares them with the standard of care and the causal link; and it analyses the impact of the precautionary principle on recent national and foreign court decisions on tort and environmental liability. It argues that the attempt for reinterpreting tort and environmental liability in the light of the precautionary principle entails the risk of distorting the gist of fault and causation, which can lead to the imposition of a strict liability without legal basis.
