IA y Derecho: Hacia un transhumanismo jurídico

    El presente artículo identifica algunas proposiciones que permiten afirmar la existencia del concepto de Transhumanismo Jurídico, por la interconexión que existe entre el Derecho y la Inteligencia Artificial (IA), como una herramienta que permite llevar más allá el desempeño del jurista. Asimismo, trata de desarrollar una interpretación y aplicación racional de este concepto. Para lograrlo, en primer lugar, se explora críticamente a los conceptos de IA y de Transhumanismo, buscando extraer de sus postulados los avances para la vigencia del concepto. En segundo lugar, se definen sus objetivos y se describen algunos de los limites técnicos que existen en las ciencias de la computación para destacar el carácter necesariamente moderado del Transhumanismo Jurídico y desmitificar los miedos existentes alrededor de la IA aplicada al Derecho.

    This article identifies some conditions that allow us to affirm the existence of the concept of Legal Transhumanism, due to evidence of an interconnection between Law and Artificial Intelligence (AI), as a tool that allows as to amplify the performance of jurists. Likewise, it outlines a rational interpretation and application of the concept. To achieve this, firstly, the concepts of AI and Transhumanism are critically explored, seeking to extract from their postulates the advances for the validity of the concept. Secondly, its objectives are defined and some of the technical limits that exist in computer science are described in order to highlight the restrictions of Legal Transhumanism and to demystify the existing fears around AI as it applies to law.
