El iuspositivismo político-ideológico de Uberto Scarpelli y los principios del Derecho

    Mi finalidad en este artículo es examinar las tesis de Uberto Scarpelli acerca del iuspositivismo a la luz del debate acerca de la distinción de Dworkin entre reglas y principios. Como primer paso, reconstruyo el pensamiento de Scarpelli en ¿Qué es el positivismo jurídico? y otros escritos, a partir de un análisis detallado del contexto histórico en el que se va formando, inmediatamente antes y después de la Segunda Guerra. Para ello, tomo en consideración, sobre todo, las conocidas tesis de Norberto Bobbio sobre el iuspositivismo, que constituyen –junto con las ideas de Herbert Hart– el núcleo central hacia donde se dirigen las críticas de Scarpelli, y que le conducen a postular su tesis de un iuspositivismo político. Un iuspositivismo político que se presenta, ésta es la idea que sugiero, como un iuspositivismo ideológico extremo, es decir válido para dar cuenta no solo del ordenamiento de un Estado democrático y constitucional sino de cualquier ordenamiento, con cualquier contenido.

    My aim in this paper is to examine Uberto Scarpelli’s thesis about Legal Positivism in light of the debate about Dworkin’s distinction between rules and principles. As a first step, I reconstruct Scarpelli’s thought in ¿Qué es el positivismo jurídico? and other writings, from a detailed analysis of the historical context in which it is being formed, immediately before and after the Second War. For this, I take into account, above all, the well-known Norberto Bobbio’s theses on Legal Positivism, which constitute –together with the ideas of Herbert Hart– the central nucleus where Scarpelli’s criticisms are directed, and which lead him to postulate his thesis of a Political Legal Positivism. A Political Legal Positivis that is presented, this is the idea I suggest, as an extreme Ideological Legal Positivism, that is, valid to account not only for the legal order of a democratic and constitutional State but for any legal order, with any content.
