Conflicts and tensions are interposed in the Constitutional Jurisdiction in Brazil. In an organization founded on the separation of pow-ers, which is clearly and definitively ruled in the Constitution of the Brazilian Federative Republic of 1988 and which has as ultimate guardian the Supreme Federal Court, one of the branches of the govern, conflicts between federal powers are possible or even inevitable. Various examples demonstrate this reality. In this article some examples of conflicts between the Supreme Federal Court and the Legislative National Power are examined just to demonstrate the high level of controversy which they arise and which involve serious inquiry on the strength of Brazilian constitutional standards.

Conflitos e tensões permeiam a jurisdição constitucional no Brasil. Em organização estatal fundada na separação de poderes, que é disciplinada de modo expresso e, por vezes, taxativo na Constituição da República Federativa do Brasil de 1988, e que tem como guardião o Supremo Tribunal Federal, um dos poderes constituídos, conflitos entre poderes são possíveis ou mesmo inevitáveis. Vários exemplos demonstram essa realidade. Neste artigo alguns exemplos de conflitos entre o Supremo Tribunal Federal e o Poder Legislativo são examinados em razão do nível da polêmica que suscitam e por envolverem sério questionamento sobre a força normativa da Constituição brasileira.
