Il presente contributo analizza l’ordinanza del GIP di Agrigento, emanata nella fase cautelare del procedimento a carico di Carola Rackete, successivamente oggetto di ricorso in Cassazione. Pur non sottacendone le criticità, si tenta di calare la stessa nella più ampia tematica dell’ardua e costante ricerca di un punto di equilibrio tra sovranità statuale ed obblighi sovranazionali; tra giustizia ed ordine giuridico.
This work analyzes the order of the Examining Judge of the Court of Agrigento in the precautionary phase of the criminal proceedings against Carola Rackete, subsequently subject to appeal in Cassation. Despite its critical issues, it will be attempted to place the same in the wider context of the arduous and constant research for a balance between State sovereignty and sovranational obligations; between justice and juridical order.
