Resumen de O pluralismo jurídico, o transconstitucionalismo e comunidades quilombolas

  The Brazilian Constitution (1988) has in its text provision for protection of Afro-descendant communities, while, although tempered by the social function, there is also provision for protection of private property. The struggle for the recognition of the quilombola right has been causing violent attacks in several parts of the country, with deaths of several quilombola leaders and weakening of the feeling of nation. Through an interdisciplinary bibliographical research between law and sociology, topics such as pluralism, transconstitutionalism and the democratization of knowledge are tried, in an attempt to demonstrate the existence of other legal systems with different rationalities of the state legal order and the need to recognize this "other”, in the form of a unilateral transconstitutionalism of tolerance and learning. The conclusion of the work is in line with the notion of recognition of the existence of existing legal orders in quilombola communities, and in other traditional populations, as differentiated in relation to the state legal order, in the form of knowledge producing orders and users of the legal / illicit code

  A Constituição brasileira (1988) possui em seu texto previsão de proteção às comunidades afrodescendentes, ao passo que, apesar de temperada pela função social, também há previsão de proteção da propriedade privada. A luta pelo reconhecimento do direito quilombola vem causando violentos embates em várias partes do país, com mortes de vários líderes quilombolas e enfraquecimento do sentimento de nação. Por meio de pesquisa bibliográfica interdisciplinar entre direito e sociologia aborda-se temas como pluralismo, transconstitucionalismo e a democratização dos saberes, na tentativa de demonstrar a existência de outros ordenamentos com racionalidades distintas do ordenamento jurídico estatal e a necessidade de este reconhecer esse “outro”, na forma de um transconstitucionalismo unilateral de tolerância e aprendizado. A conclusão do trabalho vai ao encontro da noção de reconhecimento da existência de ordens jurídicas existentes nas comunidades quilombolas, e em outras populações tradicionais, como diferenciadas em relação à ordem jurídica estatal, na forma de ordens produtoras de conhecimento e utilizadoras do código lícito/ilícito
