Resumen de Consequências jurídicas do descumprimento da função socioamental da propriedade rural no Brasil

  The social function of property, guaranteed constitutionally, imposes the duty to use rural property in a rational and ecological way. This paper analyzes the concept of socio-environmental function of rural property in Brazil, as well as verifying the possibility of expropriation for the purpose of agrarian reform, allowing the alteration of the unjust land structure of the country. For this analysis, a comparison was made between the old individualist thought of property and the new model linked to the social function. Starting from the theoretical and axiological paradigm of sociability, the articles of the Constitution of the Republic were analyzed that determine the requirements for this function to be effectively fulfilled, in order to analyze the different interpretations, especially in relation to the expression "productive property" of article 185 and, finally, what are the consequences of the non-fulfillment of the social function. The work was carried out by bibliographic and documentary research, with an analysis of judgments regarding the socio-environmental function of the property

  A função social da propriedade, garantida constitucionalmente, impõe o dever de usar a propriedade rural de forma racional e ecológica. O presente artigo analisa o conceito de função socioambiental da propriedade rural do Brasil, além de verificar a possibilidade de realizar a desapropriação para fins de reforma agrária permitindo a alteração da injusta estrutura fundiária do país. Para tal análise, foi realizada uma comparação entre o antigo pensamento individualista da propriedade e o modelo novo vinculado à função social. Partindo do paradigma teórico e axiológico da sociabilidade, foram analisados os artigos da Constituição da República que determinam os requisitos para que essa função seja efetivamente cumprida, a fim de analisar as diferentes interpretações, principalmente em relação à expressão “propriedade produtiva” do artigo 185 e, por fim, quais são as consequências do descumprimento da função social. O trabalho foi realizado por pesquisa bibliográfica e documental, com análise de julgados atinentes à função socioambiental da propriedade.
