    The struggle for the guarantee of quilombola rights is historical and political.

    This paper aims to address some of the mobilizations experienced in the fight for the right to land of quilombolas communities, since the Constituent Assembly process until the conclusion of the judgment that argues the constitutionality of one of the instruments of regulation of Article 68 of the ADCT of the Federal Constitution, whose Decree 4887/2003 refers. It also aims to reflect on the way in which this theme penetrated the Brazilian public space in the constituent process (1987-1988) and has gone through regulatory instruments and ways of implementing this just after the 1988 Constitution.

    A luta pela garantia dos direitos quilombolas é histórica e política. O presente trabalho tem como objetivo abordar algumas das mobilizações vivenciadas na luta pelo direito à terra das comunidades quilombolas desde o processo da Assembleia Constituinte, até a conclusão do julgamento que questionava a constitucionalidade de um dos instrumentos de regulamentação do Artigo 68 do ADCT da Constituição Federal, que é o Decreto 4887/2003. Visa refletir, também, sobre a forma como esse tema adentrou o espaço público brasileiro no processo constituinte (1987-1988) e perpassou por instrumentos de regulamentação e formas de implementação desse direito pós Constituição de 1988.
