A súmula 57 e as categorias de trabalho no campo: os trabalhadores rurais na justiça do trabalho

    The sugar workers who started the Labor Court in the municipality of Goiana, Zona da Mata de Pernambuco in the years 1979 and 1980, would sometimes declared themselves "rural workers", sometimes "industrials". This distinction was based on the legal provision of Summary 57 and often afforded them access to higher wages. The objective of this article is to discuss how the category of "rural worker" widens from the use of the Summary 57, as well as to analyze the discursive strategies built by the bosses to try to bar this tactic of the workers. Finally, judges 'sentences form the third aspect of analysis, where I try to understand the judges' interpretation of judicial disputes, legitimizing or not the tactics and strategies of employees and employers.

    Os trabalhadores do açúcar que acionavam a Justiça do Trabalho no município de Goiana, Zona da Mata de Pernambuco nos anos de 1979 e 1980 ora declaravam-se “trabalhador rural”, ora “industriário”. Essa distinção baseava-se no dispositivo legal da Súmula 57 e não raro lhes possibilitava o acesso a maiores salários. O objetivo deste artigo é discutir como a categoria de “trabalhador rural” se alarga a partir do uso da Súmula 57, bem como analisar as estratégias discursivas construídas pelos patrões para tentar barrar esta tática dos trabalhadores. Por fim, as sentenças dos magistrados compõem o terceiro aspecto de análise, onde procuro compreender a interpretação dos juízes a respeito das disputas judiciais, legitimando ou não as táticas e estratégias dos empregados e empregadores.
