La pérdida de la libertad y de la ciudadanía fueron efectos directos del cautiverio de los ciudadanos romanos. El regreso del cautivo, por aplicación del postliminio, suponía la recuperación de sus derechos. En materia sucesoria, uno de las consecuencias principales de la cautividad era la nulidad del testamento realizado antes o durante la prisión. La lex Cornelia de confirmandis testamentis eorum qui in hostium potestate decessissent, promulgada entre los años 84-81 a. C. admitiría el testamento previo del cautivo mediante la ficción de que había muerto en el momento de su captura. Parece que la jurisprudencia habría extendido sus efectos a la sucesión intestada.

The loss of freedom and citizenship were direct effects of the captivity of Roman citizens. The return of the captive, by application of the ius postliminii, meant the recovery of their rights. One of the main consequences of the captivity was the nullity of the testament made before or during the prison. The lex Cornelia de confirmandis testamentis eorum qui in hostium potestate decessissent,(84-81 B C.) would admit the previous testament of the captive through the fiction that he had died at the time of his capture. It seems that jurisprudence would have extended its effects to intestacy
