En este estudio se analizará el procedimiento de reclamación de responsabilidad patrimonial del Estado legislador en los supuestos en los que una ley es declarada inconstitucional y el perjudicado por ella ha agotado la vía de recurso habiendo obtenido una sentencia desestimatoria firme.Se pondrá en relación con las sentencias dictadas por el Tribunal Constitucional respecto del Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana.

This article we´re going to analyze the procedure for claiming patrimonial responsibility of the legislating State in the cases in which a law is declared unconstitutional and the one harmed by it has exhausted the remedy having obtained a final dismissal judgment.It will be related to the sentences handed down by the Constitutional Court in relation to the Tax on the Increase in the Value of Urban Land.
