Medio ambiente, solidaridad y dignidad humana en la Constitución brasileña

    El presente artículo aborda la relación entre dignidad humana, solidaridad y medio ambiente desde la categorización de las disposiciones ambientales constantes en el sistema constitucional brasileño vigente. Primeramente, analizamos un conjunto determinado de conceptos claves para comprender la discusión de las cuestiones ambientales en el ámbito constitucional, es decir, la consagración de los derechos fundamentales de tercera generación basados en la solidaridad y su respectiva conexión con la dignidad humana, lo que nos conduce a la definición del mínimo existencial ambiental. Posteriormente, ingresamos en los rasgos generales del Texto Constitucional brasileño, como forma de mejor entender su tipología y, por consecuencia, la estructuración de la temática ambiental. Finalmente, dedicamos el ultimo capitulo a la categorización del orden constitucional ambiental positivado, a partir de la investigación de la idea de desarrollo sostenible y su conexión con determinados derechos fundamentales, especialmente, los relacionados con la propiedad y el libre ejercicio de las actividades económicas, constatando también sus vínculos con la dignidad humana y solidaridad.

References. AbstractThe present article aims to study the relation among human dignity, solidarity and environment from the categorization of the environmental clauses present in the current Brazilian Constitutional System. First of all, we will analyze a set of determinate key concepts in order to comprehend the discussions about the environmental questions in the constitutional plan, it means, the recognition of the third generation of fundamental rights based on the solidarity and its respective connections with the human dignity, which allow us to define the concept of environmental existential minimum. After that we will enter in the debate related to the general characteristics of the Brazilian Constitution, as a way to better understand its typology and, by consequence, the structure of its environmental dispositions. Finally, the last part will be devoted to the effective categorization of the current environmental constitutional order from the research of the idea of sustainable development and its connection with some fundamental rights, specially, those related to property and free exercise of economic activities as well as their linkages with human dignity and solidarity.
