En este ensayo sentamos nuestra interpretación respecto a un punto harto polémico en lo referente a la reelección del Presidente de la República, que recientemente ha convulsionado la vida social y política de la República. Daremos una somera definición de lo que significa, en su acepción jurídica, la palabra Constitución; luego haremos una breve exposición sobre la teoría de la norma fundamental y su relación con las normas derivadas de aquella; trataremos sobre el Poder Constituyente Originario y Derivado; daremos una definición jurídica de los conceptos de reforma y de enmienda, y por último sentamos nuestra postura respecto a cuál mecanismo constitucional es el único legítimo para modificar lo relativo a la prohibición actual de la reelección del Presidente y Vicepresidente de la República.

In this essay we read our interpretation of a very controversial point regarding the re-election of the President of the Republic, which has recently convulsed the social and political life of the Republic. We will give a brief definition of what the word Constitution means in its legal sense; Then we shall give a brief account of the theory of the fundamental norm and its relation to the norms derived from it; We will deal with the Original and Derived Constituent Power; We will give a juridical definition of the concepts of reform and amendment, and finally we feel our position on which constitutional mechanism is the only legitimate one to modify what concerns the current prohibition of the re-election of the President and Vice President of the Republic.
